Terms of Service
Article 1 (Purpose)
Article 2 (Posting and Amendment of the Terms)
- These Terms shall be posted on the Service website (https://www.unipicker.com).
- The Service Provider may change the contents of these Terms when significant grounds arise.
- If a Member does not agree to the amended Terms, the Member may request withdrawal. If the Member continues to use the Service after the effective date of the amended Terms, the Member shall be deemed to have agreed to the changes.
Article 3 (Software License)
- With the Fair Draw program "UniPicker Software" distributed by the "Service", only "paid Draw Record members" may conduct record draws and event draws.
- When using additional services such as "draws with issuance of a unique draw certification code", "manager agency draws", and "public draws", you may use the draw after paying the applicable service fee.
- The 'General Record Plan' may be used when individuals, businesses, or organizations conduct draws on their own, and the 'Advertising/Marketing Agency Record Plan' is used when conducting draws on behalf of other businesses. The 'Real Estate and Sales Agency Record Plan' may be used when conducting real estate draws related to property sales.
- If a Member uses the service for a purpose other than that of their respective Record Plan, UniPicker may charge an additional usage fee or take measures such as suspending use.
- Members may not operate a draw-dedicated social media account using UniPicker.
- If a Member's draw video content is deemed to cause harm to the Service Provider, the Service Provider may suspend the Member's account.
Article 4 (Privacy Policy)
"UniPicker Software" does not collect the entrant information uploaded by the person conducting the draw for the purpose of the draw.
However, the information stated on the draw confirmation or draw certificate is retained for the draw record.
Personal Information Collected
- Membership registration: email, password, name, Google account (email)
- Draw Record Plan registration: (individual) name, email, contact
(business) contact person's name, email, contact, company name, business registration information, employment verification information
- Use of UniPicker: draw name, draw setting information, and number of winners
Article 5 (Refund Policy for Draw Record Plan Fees)
- Once a record draw application has been submitted and payment has been completed, the fee is non-refundable.
- If use of the Draw Record Plan is temporarily suspended due to a fraudulent draw, the usage fee for that month will not be refunded. Members must conduct draws with care to ensure that no fraudulent draws occur.
Article 6 (Termination of Contract and Withdrawal of Membership)
- If a Member or the Service Provider violates these Terms or fails to perform them faithfully, each party may request correction. If the correction is not completed within 7 days, the party may terminate the contract or proceed with withdrawal of membership via email or the UniPicker Software.
- After withdrawal of membership, re-registration with the same information is not possible.
Article 7 (Limitation of Liability)
- The "Service" does not guarantee the fairness of test draw results or record draws conducted directly by Members.
- The "Service" officially guarantees the fairness of the draw process only when a Member requests an "agency draw". However, it cannot verify whether the draw materials provided by the Member to the "UniPicker manager (the person who performs the agency draw)" contain errors or manipulation in the entrant information or draw setting information.
- Unless there is gross negligence on the part of the "Service Provider's" officers, employees, or managers, the "Service Provider" shall not be liable for the following damages.
- Damages arising from false or inaccurate Member information
- Damages arising from causes attributable to the "Member" in the course of accessing and using the Service
- Damages arising from any unlawful access to the server by a third party or any unlawful use of the server, and damages arising in the course of preventing or precluding the unlawful acts of a third party
- Damages caused by any virus, spyware, or other malicious program that a third party transmits or distributes, or causes to be transmitted or distributed, using the Service
Article 8 (Request for Disclosure of Draw Materials)
- If a draw entrant raises a question about the draw process or result and requests confirmation of the draw materials, such materials may be provided only with the consent of the draw host.
- An entrant who wishes to request the provision of materials must complete and submit the "Draw Material Disclosure Request Form" provided by the Service Provider.
- The Service Provider shares the submitted request form with the draw host and provides the draw materials to the entrant only if the host consents to providing the materials.
- Draw materials are retained for 2 years from the draw date and are automatically destroyed after the retention period elapses. If the materials have been destroyed because the retention period has elapsed, such materials cannot be provided.
- In accordance with personal information protection and related laws, if the draw host requests destruction of the materials for reasons of personal information protection or security, the Service Provider shall immediately destroy such materials. Destroyed materials cannot be provided under any circumstances.
